Regulatorisering is the process by which authorities introduce, expand, or reorganize regulatory oversight in a sector or activity. It involves creating formal rules, institutions, and enforcement mechanisms that accompany or replace informal norms and market arrangements. Regulatorisering can affect how products are manufactured, services are delivered, and activities are conducted, with aims such as reducing risk, protecting consumers, preserving competition, and safeguarding the environment.

Key drivers include market failures, information asymmetries, externalities, and concerns about public safety. Regulatory actions take many forms: licensing and permitting; performance or safety standards; disclosure and reporting requirements; price or access controls; and market-based tools like taxes, subsidies, or cap-and-trade schemes. Regulatorisering is implemented by regulators, ministries, or independent agencies, and may involve sector-specific and cross-cutting rules.

The process typically combines policy design with impact assessment and stakeholder consultation, followed by rule adoption, implementation, and enforcement. Monitoring and evaluation, sometimes with sunset clauses or ex-post adjustments, are common. For cross-border activities and digital platforms, international coordination and harmonization can be important.

Outcomes and debates: supporters point to greater safety, market integrity, and resilience; critics warn of compliance costs, regulatory burden, and potential stifling of innovation. A balance between proportionality, certainty, and flexibility is a central design challenge, with evolving approaches such as risk-based regulation and adaptive rules.
