Perintömenettelyssä

Perintömenettelyssä is a Finnish legal term referring to the probate process or inheritance proceedings. It encompasses the legal steps taken after a person's death to transfer their assets and liabilities to their heirs. This process is governed by Finnish inheritance law, which outlines the rights and responsibilities of beneficiaries and the deceased's estate.

The primary goal of perintömenettelyssä is to identify the deceased's assets and debts, determine the legal heirs, and distribute the inheritance accordingly. This typically involves several stages. First, the death is reported to the relevant authorities, and a preliminary inventory of the estate may be compiled.

Next, a formal declaration of inheritance, known as "perukirja," must be drawn up and submitted to the tax authorities. This document lists all assets, liabilities, and the names of the heirs. Following this, a distribution of the estate can occur, either through an agreement among the heirs or, if an agreement cannot be reached, through court-ordered partition proceedings.

Debts of the deceased must be settled before assets can be distributed to the heirs. If the estate's liabilities exceed its assets, the heirs may choose to renounce their inheritance to avoid personal responsibility for the debts.
