Patentointi

Patentointi is the process by which an inventor can protect their invention and gain exclusive rights to it for a limited period. This process is governed by national patent laws and international treaties. To be granted a patent, an invention must typically meet three main criteria: it must be novel, meaning it has not been previously disclosed to the public; it must involve an inventive step, meaning it is not obvious to someone skilled in the relevant field; and it must be capable of industrial application, meaning it can be made or used in some kind of industry.

The patent application process usually begins with filing an application at a national or regional patent office. This application includes a detailed description of the invention, its technical background, and how it works, along with claims that define the scope of protection sought. Patent offices then examine the application to determine if it meets the legal requirements. If the patent is granted, the inventor receives a patent certificate, which provides the exclusive right to prevent others from making, using, selling, or importing the invention without permission for a set term, typically 20 years from the filing date.

Patents are territorial, meaning a patent granted in one country only provides protection in that country. To obtain protection in multiple countries, inventors must file separate applications in each jurisdiction or use international filing systems like the Patent Cooperation Treaty (PCT). The purpose of patenting is to encourage innovation by allowing inventors to benefit from their work, while also promoting the dissemination of technical knowledge to the public once the patent expires.
