Onderlicentiëring

Onderlicentiëring, a Dutch term, translates to sublicensing in English. It refers to a contractual arrangement where a licensee, who has obtained rights from a licensor to use intellectual property, further grants those same rights to a third party. This is distinct from a direct license from the original licensor. The original licensor typically must approve of the sublicensing agreement, and there are often limitations on what rights can be sublicensed and under what conditions.

This practice is common in various industries, including software, technology, and media. For instance, a company that has licensed a patented technology from its inventor might then sublicensethat technology to other manufacturers to expand its reach. Similarly, a media company holding broadcasting rights for a particular event might sublicensethose rights to local broadcasters in different regions.

The terms of a sublicense agreement are negotiated between the original licensee and the sublicensee, but they are bound by the terms of the original license. The original licensee remains responsible to the licensor for the sublicensee's actions and compliance with the original license. This means the original licensee often acts as an intermediary, managing the relationship and ensuring royalty payments are made. Sublicensing allows for broader dissemination of intellectual property and can create new revenue streams for all parties involved.
