Mieterhöhungen, German for rent increases, are a common aspect of the rental market. In Germany, there are specific legal regulations governing how and when landlords can increase rent. The most common type of rent increase is based on the local comparative rent, known as the Mietspiegel. This is a statistical overview of rents for comparable apartments in a specific municipality. Landlords can generally raise the rent up to the level of the Mietspiegel, provided certain conditions are met, such as the apartment not having been modernized or the rent not having been increased recently.

Another form of rent increase is linked to modernization measures. If a landlord carries out significant renovations or energy efficiency improvements, they are allowed to pass on a portion of these costs to the tenants through a rent increase. However, there are limits to how much can be charged and specific notification requirements. So-called index-linked rents, tied to the consumer price index, are also possible but less common. This type of rent increase automatically adjusts with inflation.

Tenants have the right to review the Mietspiegel and the basis for any modernization-related rent increase. If a tenant believes a rent increase is not justified or exceeds the legal limits, they can object to it. The legal framework aims to protect tenants from arbitrary rent hikes while allowing landlords to adjust rents to market conditions and cover costs for maintenance and improvements.
