Meghatalmazási

Meghatalmazási refers to the legal concept of authorization or mandate in Hungarian law. It is the act by which one person, the principal (meghatalmazó), grants another person, the agent (meghatalmazott), the authority to act on their behalf. This authority can be broad or specific, depending on the terms of the authorization.

Meghatalmazási typically takes the form of a written document, although oral authorizations are permissible in certain limited circumstances. The document clearly outlines the scope of the agent's powers, the duration of the authorization, and any conditions that must be met. Common areas where meghatalmazási is used include legal representation, financial transactions, property management, and healthcare decisions.

For the authorization to be valid, the principal must have the legal capacity to grant it, meaning they must be of sound mind and legal age. The agent must also accept the mandate and act within the bounds of the authority granted. If the agent exceeds their authority or acts negligently, they may be held liable for any damages incurred by the principal.

The termination of meghatalmazási can occur for various reasons, including the completion of the authorized task, the expiration of a specified period, the death or incapacitation of either the principal or the agent, or by explicit revocation by the principal. It is an essential legal tool that facilitates smooth operations in many personal and professional contexts, ensuring that individuals can delegate tasks and responsibilities when they are unable or unavailable to attend to them personally.
