Megbízást

Megbízás, in the accusative form Megbízást, is a term used in Hungarian civil law to describe a contract of mandate. In a megbízási szerződés one party, the megbízó (principal), entrusts another party, the megbízott (mandatary or agent), to perform a specific task or to act on the megbízó’s behalf. The arrangement is a civil-law contract and does not create an employment relationship, though it can involve professional services. The contract is governed by the Hungarian Civil Code (Polgári Törvénykönyv).

The parties and scope of authority define what the megbízott may do on the megbízó’s behalf. The megbízott must perform the task with due care, in accordance with instructions, and in good faith. The megbízó is typically obliged to pay reasonable remuneration and reimburse approved expenses; the megbízott may be required to provide accounts and deliver results.

Form and termination: A megbízási szerződés can be concluded orally or in writing, with written form preferred for evidence in many situations. It ends upon completion of the task, by mutual agreement, or through termination in accordance with the contract. The megbízó generally may revoke the mandate, subject to consequences such as damages if revocation causes harm to the megbízott or third parties.

Liability and use: If the megbízott acts within the authorized scope, liability generally lies with the megbízó for the resulting legal acts; if the megbízott acts negligently or beyond authority, he may be liable for damages. Common contexts include representation, brokerage, consultancy, and other professional services, distinguishing the mandate from employment or ongoing service contracts.
