Letartóztatás

Letartóztatás is a Hungarian legal term referring to the detention of a person by the authorities, usually as part of a criminal investigation. It is a pre-trial measure that restricts an individual's liberty for a specific period. The purpose of letartóztatás is to prevent the accused from obstructing justice, fleeing, or committing further crimes while the investigation is ongoing. It is not considered a punishment but rather a procedural step.

A letartóztatás can only be ordered by a court, based on a request from the prosecutor. The decision must be justified and based on concrete evidence suggesting the necessity of detention. The law outlines specific grounds for ordering letartóztatás, such as the suspicion of a serious offense, the risk of the accused absconding, or the danger of re-offending. The duration of letartóztatás is limited by law and can be extended by a court if the conditions remain met. During this period, the detained person has certain rights, including the right to legal representation and the right to challenge the detention order. The conditions of detention are regulated to ensure humane treatment. If the court later finds insufficient grounds for continued detention, or if the investigation concludes, the letartóztatás is lifted.
