Kuluttajansuostumus

Kuluttajansuostumus refers to the consent given by a consumer in Finland. This concept is particularly relevant in areas such as data protection, marketing, and contract law. It signifies that an individual has willingly and knowingly agreed to a particular action or set of terms.

In the context of data protection, kuluttajansuostumus is a cornerstone of the General Data Protection Regulation (GDPR). For companies to process a consumer's personal data, they often require explicit consent. This consent must be freely given, specific, informed, and unambiguous. Consumers have the right to withdraw their consent at any time, and this withdrawal should be as easy as giving the original consent.

In marketing, consumer consent is crucial for sending unsolicited commercial communications. Finnish law, in line with EU directives, generally prohibits spam unless prior consent has been obtained. This applies to emails, text messages, and other forms of direct marketing.

In contractual matters, consumer consent is implied when a consumer agrees to the terms and conditions of a service or purchase. This agreement can be explicit, such as ticking a box online, or implicit, such as by using a service after being presented with its terms. However, the understanding of these terms is key to valid consent. The principle is that consumers should not be bound by terms they have not reasonably had the opportunity to understand or agree to.
