Ilaikymas

Ilaikymas is a temporary deprivation of liberty carried out by police or other state authorities, typically to enable investigation, secure presence at proceedings, or prevent harm. It is a phase in the criminal procedure that precedes or accompanies formal arrest and is distinct from longer-term detention or imprisonment.

In the Lithuanian legal system, laikymas is regulated by codes and laws governing criminal procedure and police powers. It is typically ordered when there is a reasonable suspicion of involvement in a crime and a demonstrated need to question the person or to safeguard the investigation. Detainees must be informed of the reasons for their detention and the charges or potential charges, and the detention is documented in an official record.

Duration and oversight are designed to be time-limited and subject to judicial control. Extensions, if applicable, generally require a court decision, ensuring that the detention remains lawful and proportionate. At any stage, the person detained has rights designed to protect due process, including access to legal counsel, the ability to inform a family member or representative, and access to interpretation if needed. In the case of foreign nationals, contact with consular authorities may be facilitated.

If detention is perceived as unlawful or excessive, detainees or their representatives can seek expedited review or release through legal channels, complaints to supervisory bodies, or other remedies provided by law. The system emphasizes proportionality, transparency, and safeguards against abuse, while balancing public safety and investigative needs.
