Homologação

Homologação is the act by which a competent authority formally validates or ratifies an act, contract, or agreement, giving it full legal effect within a jurisdiction. The term comes from the Latin homologare, meaning to approve as the same or to recognize as valid. In civil and administrative law, a judge or equivalent authority may homologate settlements or conciliated agreements, transforming them into enforceable orders and ensuring compliance with the law and the rights of the parties. The process is designed to guarantee good faith, procedural fairness, and the enforceability of the agreed terms.

In labor law, homologação commonly refers to the validation of a termination agreement or severance-related arrangements by a competent body, confirming that workers’ rights have been respected and enabling the release of funds or obligations tied to the contract’s end. In international law, homologação denotes the recognition or validation of foreign judgments or arbitral awards so that they can be enforced domestically, subject to reciprocity and public policy requirements.
