Fogvatartott

Fogvatartott is a term used in Hungary to refer to a person who is held in the custody of law enforcement or judicial authorities during criminal proceedings and who has not yet been convicted. The status typically covers individuals who are in police custody (őrizetbe vétel) or who have been placed under pre-trial detention (előzetes letartóztatás) by a court.

Legal basis and procedure: The fogvatartott status is governed by the Code of Criminal Procedure and constitutional protections. Detention is initiated by police or prosecutors and is subject to court oversight, with safeguards intended to balance the right to a fair procedure with public safety. The detention arrangement can be reviewed or renewed by the courts, and the person detained has the right to challenge the continuation of detention through legal remedies.

Rights and treatment: Fogvatartott has the right to be informed of the grounds for detention and the charges, to legal counsel and to communicate with a defence attorney, and to notify family or other contacts. They must receive necessary medical care and be kept in humane conditions. They have access to interpretation if needed, and can file complaints about treatment or procedures. Detention must comply with prohibitions on torture and inhumane or degrading treatment, and procedural safeguards exist to review continued detention.

Status and outcomes: If detention ends without charges, the person is released. If the case proceeds and results in conviction, the person may be transferred to a prison (börtön) and become an inmate. If acquitted, they are released. The term fogvatartott should not be confused with a convicted prisoner.
