Erbrechtserbe

Erbrechtserbe refers to an heir who inherits under German inheritance law. This concept is fundamental to understanding how assets are distributed upon a person's death. There are two primary categories of heirs in German law: the statutory heir (gesetzlicher Erbe) and the testamentary heir (testamentarischer Erbe).

A statutory heir inherits based on legal provisions, typically close relatives such as a surviving spouse, children, or parents, depending on their proximity of relationship. The order and share of inheritance for statutory heirs are precisely defined in the German Civil Code (Bürgerliches Gesetzbuch - BGB).

A testamentary heir, on the other hand, inherits based on a will or other testamentary disposition made by the deceased. The deceased has the freedom to designate heirs in their will, potentially deviating from the statutory order of succession, although certain mandatory heirs (Pflichtteilsberechtigte) are protected by law and have a right to a minimum share.

The erbrechtserbe, regardless of whether they are a statutory or testamentary heir, acquires the entire legal position of the deceased, including both assets and liabilities. This means they are entitled to the deceased's property but also responsible for their debts. The inheritance becomes the property of the erbrechtserbe upon the death of the testator, and formal acceptance or renunciation of the inheritance is usually required.
