Dokumentenkredits

Dokumentenkredits, also known as documentary credits or letters of credit, are payment instruments commonly used in international trade. They provide a secure method for buyers and sellers to conduct transactions by mitigating payment risks. Essentially, a bank guarantees payment to the seller on behalf of the buyer, provided the seller presents specific documents that comply with the terms and conditions of the credit.

The process typically begins with the buyer (applicant) requesting their bank (issuing bank) to open a dokumentenkredit in favor of the seller (beneficiary). The issuing bank then forwards the credit to a bank in the seller's country (advising bank or nominated bank), which informs the seller. The seller ships the goods and gathers the required documents, such as the bill of lading, invoice, and insurance certificate.

Once the seller presents these compliant documents to their bank, that bank checks them against the terms of the credit. If everything is in order, the bank will pay the seller. The bank then forwards the documents to the issuing bank, which reimburses the seller's bank and debits the buyer's account or extends credit. This system ensures the seller receives payment and the buyer receives the goods as per the agreed terms.

Dokumentenkredits are governed by the Uniform Customs and Practice for Documentary Credits (UCP), a set of rules published by the International Chamber of Commerce (ICC), ensuring standardization and clarity in their application worldwide. They are particularly useful when parties are unfamiliar with each other or operate in jurisdictions with different legal systems and payment practices.
