Cselekvképes

Cselekvképes is a Hungarian term that translates to "capable of action" or "legally competent." It refers to a person's legal capacity to undertake valid legal acts and make binding decisions. This concept is fundamental in civil law systems, particularly in areas concerning contracts, property, and personal rights.

In Hungary, a person is generally considered cselekvképes if they have reached the age of majority, which is 18 years old, and are not suffering from a mental disorder that prevents them from understanding the nature and consequences of their actions. Legal capacity is presumed unless proven otherwise through a court ruling.

Minors, typically under the age of 18, and individuals declared legally incompetent by a court due to mental incapacity, are considered cselekvképtelen, meaning they lack the capacity to act. In such cases, a legal representative, such as a parent or guardian, acts on their behalf.

The determination of cselekvképes status is crucial for the validity of legal transactions.
