Manufacturers are responsible for ensuring their products are compliant before placing them on the market. This involves identifying all relevant EU directives and regulations, conducting or arranging for conformity assessments, and affixing the CE mark to the product. The specific requirements vary depending on the product category. For some products, a self-declaration of conformity may suffice, while for others, a third-party Notified Body must be involved in the conformity assessment process.

Distributors also have obligations regarding CE marked products. They must exercise due care to ensure that products bearing the CE mark are accompanied by the required documentation and that the marking is correctly affixed. Importers of products from outside the EEA have similar responsibilities to those of manufacturers, ensuring the product conforms to EU requirements before it is made available on the EU market. Failure to comply with CE marking obligations can result in products being withdrawn from the market, fines, and other legal consequences.
