Brugsretter

Brugsretter, often translated as usufructuary rights or rights of use, are legal entitlements that grant an individual or entity the right to use and enjoy the benefits of another person's property without owning it. This concept is prevalent in various legal systems, particularly those influenced by civil law traditions. Brugsretter typically involve a distinction between ownership (the right to possess, dispose of, and control property) and the right of use, which is a more limited form of entitlement.

These rights can arise from various sources. They might be established through a contract, such as a lease agreement or a usufruct agreement, or they can be granted by law, for instance, in cases of inheritance or marital property. The specific terms and conditions of a brugsret are usually defined by the instrument that creates it, outlining the scope of use, duration, and any associated obligations, such as maintenance or payment of fees.

Common examples of brugsretter include the right to live in a property owned by someone else, the right to farm land belonging to another, or the right to use a specific resource, like water from a shared well. The holder of a brugsret, known as the usufructuary, has the right to derive income or other benefits from the property, but they are generally obligated to preserve the substance of the property and not to damage or alienate it. When the brugsret expires, for example, upon the death of the usufructuary or the termination of a contract, the property reverts to the full control of the owner.
