Überlastungshaft

Überlastungshaft refers to a legal concept in German law concerning liability for overloading a vehicle. It primarily addresses the responsibility of the person who causes a vehicle to be overloaded, typically the consignor or shipper of goods, and potentially the carrier if they knowingly accept an overloaded vehicle.

The core principle is that exceeding the permissible weight limits of a vehicle can lead to accidents, increased wear and tear on infrastructure, and environmental damage. Therefore, legal frameworks exist to assign fault and financial responsibility in such cases.

In Germany, the Überlastungshaftung can arise from various legal provisions, including traffic regulations (Straßenverkehrsordnung - StVO) and civil liability rules (Bürgerliches Gesetzbuch - BGB). The consignor has a duty to ensure the load is correctly declared and does not exceed weight limits. If they fail to do so, they can be held liable for damages resulting from the overload.

The carrier also bears responsibility. They are obligated to check the weight of the vehicle before commencing a journey and must refuse to transport an overloaded vehicle. Failure to do so can also result in liability, particularly if they were aware or should have been aware of the overload.

Penalties for overloading can include fines, points on a driver's license, and civil claims for damages. These damages can encompass costs related to accident repair, road damage, and in some cases, environmental remediation. The specific liability can depend on the circumstances, including the degree of overload and the knowledge of the parties involved.
