vymahatelná

Vymahatelná is a Czech adjective meaning enforceable or capable of being enforced by law. In legal usage it describes rights, claims, or documents that can be compelled through enforcement procedures. A vymahatelná pohledávka, for example, is a receivable that a creditor can collect by legal means.

The central condition for enforcement is the existence of an enforceable title (vykonatelný titul). Common examples include a final and enforceable court judgment, a notarial deed carrying an enforceable clause, or a settlement approved by a court or containing such clause. Without an enforceable title, a creditor typically must pursue ordinary remedies, which may involve longer proceedings.

To initiate enforcement, the creditor submits a request to the competent exekutorský úřad (bailiff’s office). The exekutor then selects appropriate methods of enforcement, such as seizure of assets, wage garnishment, freezing bank accounts, or other permissible measures. The debtor has rights in the process, including the ability to object, request deferral, or claim statutory exemptions from enforcement. The enforceability of a claim can also be affected by defenses such as prescription (promlčení) or other statutory limits.

Vymahatelná is a fundamental concept in Czech civil procedure and commercial practice, indicating that a claim or obligation can be forcibly satisfied under the law. The term appears frequently in contracts, court and notarial records, and other official documents to denote enforceability.
