A tööleping, or employment contract, is a legally binding agreement between an employer and an employee that outlines the terms and conditions of their working relationship. In Estonia, the Employment Contracts Act (Töölepingu seadus) governs these agreements, ensuring that both parties understand their rights and obligations.

The essential elements of a tööleping include the identity of the parties, the commencement date of employment, the employee's job description and duties, the place of work, the agreed-upon working hours, the amount and method of remuneration, and the duration of the contract, if it is for a fixed term. A tööleping can be concluded for an indefinite period (tähtajatu tööleping) or a fixed term (tähtajaline tööleping). Fixed-term contracts are permissible only in specific circumstances as defined by law. The contract must be in writing and signed by both the employer and the employee before the commencement of work.

Termination of a tööleping can occur through mutual agreement, by either party giving notice as stipulated by law and the contract, or in cases of gross misconduct or other legally defined reasons. Estonian law provides protections for employees regarding notice periods, severance pay, and protection against unfair dismissal.
