Pärimisega refers to the process of inheritance in Estonian law. It governs how the assets and liabilities of a deceased person, known as the testator or deceased, are transferred to their heirs. This process is primarily regulated by the Law of Succession.

There are two main ways inheritance can occur: by law or by will. Inheritance by law, or intestate succession, applies when the deceased has not left a valid will. In such cases, Estonian law designates a specific order of heirs, starting with close relatives like children and surviving spouses. If no immediate relatives exist, the inheritance passes to more distant relatives.

Inheritance by will, or testate succession, occurs when the deceased has made a will. A will allows the testator to specify how their property should be distributed and who their heirs should be, potentially deviating from the legal order of succession. However, there are legal limitations, such as the compulsory share, which protects certain close relatives from being completely disinherited.

The inheritance process typically involves declaring the inheritance and formally accepting or renouncing it. Heirs have a set period to make this decision. If accepted, they inherit both the assets and debts of the deceased. If renounced, they are not liable for the deceased's obligations. The formal acceptance of an inheritance can lead to co-ownership of the inherited property among the heirs until a division of the inheritance is carried out.
