Pesänjakosopimus is a Finnish legal term referring to a written agreement that distributes the estate of a deceased person among the heirs. This agreement is made after the estate inventory has been completed and the net value of the estate has been determined. The purpose of a pesänjakosopimus is to finalize the division of assets and debts, thereby transferring ownership to the rightful beneficiaries.

Typically, a pesänjakosopimus is drafted with the assistance of a notary public or a lawyer, although it can also be prepared by the heirs themselves if they are in complete agreement. The agreement must specify the assets and liabilities of the deceased and how they are to be divided. It should clearly identify each heir and their respective share of the estate. This can include real estate, money, securities, personal belongings, and any outstanding debts.

If the heirs cannot reach a unanimous agreement on the division of the estate, a pesänjakaja, an independent estate distributor appointed by the District Court, may be appointed to resolve the dispute. In such cases, the pesänjakaja will create a formal distribution plan, which may then be submitted to the court for approval. However, a pesänjakosopimus is the preferred method as it allows for a more flexible and often faster resolution, reflecting the wishes of the heirs.
