megbízásban

Megbízásban refers to a legal relationship in Hungarian law that is similar to a mandate or agency agreement. It is a contract where one party, the mandator (megbízó), entrusts another party, the mandatary (megbízott), with a task or business. The mandatary undertakes to perform this task on behalf of and in the interest of the mandator.

Key characteristics of a megbízásban include the personal nature of the service, meaning the mandatary is generally expected to perform the task themselves, though delegation is possible under certain conditions. The agreement is typically based on trust and good faith. The mandatary is obliged to act according to the instructions of the mandator, and to keep them informed about the progress of the task.

Remuneration for the mandatary is not always a mandatory element of the contract. It can be agreed upon by the parties, and if not, it may still be due if the task is typically performed for compensation. The mandator is obligated to reimburse the mandatary for any expenses incurred in performing the task and to compensate them for any damages suffered in connection with the execution of the mandate, provided these were not caused by the mandatary's fault.

The megbízásban relationship can be terminated by either party, usually with a notice period, unless specific circumstances allow for immediate termination. This type of contract is common for various services, such as legal representation, artistic commissions, or general business advisory roles. It provides a flexible framework for engaging services where the precise nature of the work might evolve.
