jõustatavus

Jõustatavus is a term used in Estonian law referring to the enforceability or entry into force of a normative act, contract, or international agreement. It denotes when a rule becomes legally binding and capable of producing legal effects for individuals and authorities. In short, jõustatavus combines the moment a rule is published, takes effect, and can be applied in practice.

In domestic law, jõustatavus is tied to publication and a specified entry-into-force date. In Estonia, most normative acts are promulgated in the Official State Gazette (Riigi Teataja) and acquire force on a defined date or from the moment of promulgation if no date is stated. Some provisions include transitional periods to facilitate implementation. A rule may be valid in theory but not yet enforceable until its jõustatavus occurs.

The concept also encompasses the relationship between validity and enforceability. An act can be legally valid without being immediately enforceable if the transitional rules or constitutional constraints delay its application. Conversely, once jõustatavus begins, individuals and authorities must comply, and the rule can be invoked in court or administrative procedures.

Internationally, jõustatavus relates to treaties and agreements that enter into force after conditions such as ratification or accession are met, and, if applicable, after domestic implementing measures are adopted.
