Wohnraummietverträge

Wohnraummietverträge, also known as residential lease agreements, are legally binding contracts between a landlord and a tenant for the rental of a dwelling. These agreements outline the rights and obligations of both parties. Key elements typically included in a Wohnraummietvertrag are the identification of the landlord and tenant, a precise description of the rented property, the rental amount (Miete), the security deposit (Kaution), the lease duration, and any specific house rules or conditions.

German law provides a strong framework for residential tenancy to protect tenants. For example, rent increases are regulated, and landlords generally need a valid reason to terminate a lease. The duration of a lease can be fixed-term (befristet) or indefinite (unbefristet). Indefinite leases are more common and provide greater security for the tenant. Notice periods for termination are also legally defined and vary depending on the length of the tenancy.

Before signing, tenants should carefully review all clauses. Issues such as the condition of the property at handover, included utilities, and repair responsibilities should be clearly understood. The deposit is meant to cover potential damages beyond normal wear and tear and is usually returned to the tenant after the lease ends, provided the property is returned in good condition. The German Civil Code (Bürgerliches Gesetzbuch) contains extensive provisions governing these contracts.
