Võlasuhtetes

Võlasuhted refers to the legal concept of debt relationships in Estonian law. It encompasses the legal framework governing the rights and obligations of parties involved in a debt. At its core, a võlasuhe arises when one party, the creditor (võlausaldaja), has a claim against another party, the debtor (võlgnik), for a performance, typically the payment of money. This relationship is established through various legal means, including contracts, torts, or unjust enrichment.

The primary obligation of the debtor is to perform the agreed-upon action, most commonly to pay a sum of money or to provide a service. The creditor, in turn, has the right to demand this performance. If the debtor fails to fulfill their obligation, the creditor may have legal recourse to enforce the debt. This can involve demanding late payment interest, seeking damages for losses incurred due to non-performance, or initiating legal proceedings to recover the debt through the courts.

Estonian law, primarily governed by the Law of Obligations Act (Võlaõigusseadus), provides detailed rules for the formation, performance, and termination of võlasuhted. It addresses aspects such as the validity of agreements, the calculation of interest, the statute of limitations for claims, and the procedures for debt enforcement.
