Végrehajtások

Végrehajtások refers to the legal process of enforcing court judgments or other enforceable titles in Slovenia. This procedure is governed by the Enforcement Act and is managed by public enforcement agents who are appointed by the Minister of Justice. The primary purpose of végrehajtások is to ensure that a creditor can collect a debt or secure a claim when the debtor fails to voluntarily fulfill their obligations.

The process typically begins when a creditor files an application for enforcement with a public enforcement agent. This application must be accompanied by an enforceable title, which can be a court decision, a notarial deed, or another document recognized by law as enforceable. Once the application is accepted, the enforcement agent will initiate enforcement measures. These measures can vary depending on the nature of the debt and the assets of the debtor. Common methods include seizure of bank accounts, garnishment of wages, seizure and sale of movable or immovable property, and restrictions on the debtor's rights.

The debtor has certain rights within the végrehajtások process, including the right to be informed about the enforcement proceedings, to object to the enforcement within a specified timeframe, and to request a deferral or installment plan for payment under certain circumstances. The enforcement agent acts impartially and is responsible for conducting the proceedings efficiently and in accordance with the law. The goal is to satisfy the creditor's claim while respecting the debtor's rights to the extent possible. If the enforcement is successful, the proceeds are distributed to the creditor, and the enforcement proceedings are concluded.
