Verzuges

Verzuges is a term used in German law to describe a situation where a debtor is in default of their payment obligations. This occurs when a debtor fails to fulfill their payment by the due date, without a valid reason. The concept of Verzuges is crucial as it triggers certain legal consequences for the debtor, primarily the obligation to pay interest on the outstanding amount.

For Verzuges to be established, typically two conditions must be met. First, the debt must be due, meaning the payment deadline has passed. Second, the debtor must have received a reminder, known as a Mahnung, from the creditor after the due date. However, there are exceptions to the Mahnung requirement. For instance, if a specific payment date was agreed upon, the debtor automatically falls into Verzuges on that date without needing a reminder.

Once a debtor is in Verzuges, they are liable for the statutory interest rate on the overdue amount. The specific interest rate is determined by law and can vary. Furthermore, the creditor may be entitled to claim damages beyond the interest if they can prove additional losses incurred due to the delay. The debtor can avoid Verzuges by proving that the delay was not their fault, for example, due to unforeseen circumstances or force majeure. The legal framework surrounding Verzuges aims to protect creditors and ensure timely payment of debts.
