Pärimisprotsessid

Pärimisprotsessid refers to the legal procedures and actions involved in the transfer of a deceased person's assets and liabilities to their heirs. This process is governed by the laws of inheritance, which vary significantly between jurisdictions.

In Estonia, the inheritance process is initiated upon the death of the testator. The heirs must typically file an application with a notary to initiate the succession proceedings. The notary then verifies the will, if one exists, and identifies the legal heirs. If there is no will, the law dictates the order of succession, usually starting with the closest relatives.

A crucial step in the pärimisprotsess is the inventory of the deceased's estate. This includes all assets, such as real estate, bank accounts, vehicles, and personal belongings, as well as any debts or liabilities. Heirs have the right to accept or renounce the inheritance within a specified period, usually six months from the date of notification of the inheritance. Accepting the inheritance means that the heirs also take on the deceased's debts.

Once the estate is inventoried and the heirs are identified, the notary facilitates the division of the inheritance according to the will or the rules of intestacy. This may involve transferring ownership of assets to the heirs. The entire process aims to ensure a legally sound and orderly transfer of property and obligations from the deceased to their rightful beneficiaries, while also settling any outstanding financial obligations.
