Preâmbulo

Preâmbulo is the introductory portion of a formal document, notably constitutions, laws, treaties, charters, or official speeches. It sets out the aims, principles, and context that motivate and guide the provisions that follow. It is distinct from the operative articles, which create rights and obligations.

Etymology: From Latin praeambulus "going before," the term passed into Romance languages as préambule (French), preámbulo (Spanish), and Portuguese preâmbulo. The Portuguese form retains the circumflex on the a to indicate vowel quality.

Legal status: The binding character of a preâmbulo varies by jurisdiction. In many systems, the preâmbulo is not itself legally operative but informs interpretation of the substantive provisions. In other contexts, especially within constitutions, it may be cited as evidence of guiding principles or historical motivation, and in some cases is treated as part of the constitutional text with normative weight.

Contents and placement: A preâmbulo typically appears at the start of a document, following the title and, if present, the date. It may include statements about the source of authority (the people or the state), the aims of the text, fundamental values such as liberty and equality, and a brief account of historical circumstances surrounding adoption.
