Nõudetäitmine

Nõudetäitmine is an Estonian legal term that translates to "enforcement of claims" or "debt collection." It refers to the legal process by which a creditor can compel a debtor to fulfill their obligations, typically financial. This process is initiated when a debtor fails to voluntarily satisfy a debt or perform a required action as stipulated in a contract or court order.

The primary mechanism for nõudetäitmine is through the bailiff system. A bailiff (täitevametnik) is a public official authorized to execute court judgments and other enforceable documents. To begin the enforcement process, the creditor must present an enforceable document, such as a court judgment, an arbitral award, or a notarial deed, to the bailiff.

Once an enforceable document is submitted, the bailiff initiates various enforcement actions. These can include seizing the debtor's assets, such as bank accounts, movable property (vehicles, equipment), or real estate. The bailiff can also garnish wages or other income of the debtor. The ultimate goal is to sell the seized assets or collect funds to satisfy the creditor's claim.

The nõudetäitmine process is governed by specific laws and regulations in Estonia, primarily the Enforcement Procedure Act (Täitemenetluse seadus). This act outlines the rights and responsibilities of creditors, debtors, and bailiffs, as well as the procedures for initiating and conducting enforcement actions. The process aims to provide a legal framework for resolving unpaid debts and ensuring that legal obligations are met.
