Nichtzustimmung

Nichtzustimmung describes the lack of approval or the act of refusing to consent to a proposed action. It is the negation of Zustimmung and is used in various contexts where voluntary and informed consent is required or expected. The term is not a single legal category, but a descriptive label for a participant’s or person’s refusal or disagreement.

In medical ethics, Nichtzustimmung reflects a patient’s right to refuse treatment. When a patient with decision-making capacity declines a proposed intervention, healthcare providers should respect the decision, provided the patient is informed and not coerced. If a patient cannot determine for themselves, a legally authorized representative may decide, but the outcome is still described as a lack of patient consent.

In data protection and research contexts, Nichtzustimmung means that processing personal data or participation in a study cannot proceed without consent. Individuals may withdraw previously given consent at any time, and non-consent must be documented and respected. Where applicable, alternatives or accommodations may be considered in light of the absence of consent.

In organizational and governance settings, Nichtzustimmung to a proposal can prevent implementation until broad agreement is reached. Repeated non-consent may lead to renegotiation, modification of the proposal, or exclusion from the decision-making process.
