Lizenzexklusivität refers to a type of licensing agreement where the licensee is granted exclusive rights to use a particular intellectual property, such as a patent, trademark, or copyright, within a defined territory or for a specific field of use. This means that the licensor, the owner of the intellectual property, agrees not to grant similar licenses to any other party within the same scope. The exclusive licensee typically gains the sole right to exploit the intellectual property, often in exchange for royalties, fees, or other forms of compensation.

The terms of an exclusive license are crucial and usually detail the scope of exclusivity, including geographical boundaries, the specific products or services covered, and the duration of the agreement. In return for the exclusive rights, the licensee often commits to certain performance obligations, such as minimum royalty payments or marketing efforts, to ensure the intellectual property is actively exploited. If the licensee fails to meet these obligations, the licensor may have the right to terminate the exclusivity or even the entire license agreement.
