Inchiriere

Inchiriere is an agreement in which the owner of a property allows another person to use it for a defined period in exchange for payment. The act of renting is called inchiriere, while the person who rents is the chirias (tenant) and the owner is the proprietar. Inchiriere can apply to real estate, as well as to other movable assets such as vehicles or equipment.

The contract of inchiriere establishes the rights and obligations of both parties. Key terms typically include the duration of the rental, the amount of rent and its payment schedule, and any security deposit or guarantee. It also covers maintenance responsibilities, use restrictions, rules regarding subletting, utilities and operating costs, and conditions for renewal or termination. The contract may specify what happens in case of damage, late payments, or breaches of other clauses.

Inchiriere is generally governed by civil law, and written contracts are common for clarity and enforceability. The owner is usually responsible for delivering the property in a usable and safe condition, while the tenant is expected to use it properly, maintain it, and pay rent as agreed. At the end of the term, the property is returned in the agreed condition, subject to normal wear and tear; the security deposit is returned after deducting any damages or unpaid charges.

Types of inchiriere include residential (housing) and commercial (shops, offices), as well as short-term versus long-term arrangements. Practical considerations include verifying the property’s condition, agreeing on all charges in writing, and understanding termination terms and notice periods.
