Haftung refers to the legal responsibility or liability of an individual or entity for their actions or omissions. In German law, it is a fundamental concept that underpins many legal relationships, including contractual and tortious obligations. The principle of Haftung ensures that individuals are held accountable for causing harm or damage to others, providing a basis for compensation and redress.

There are several types of Haftung in German law. Contractual Haftung (vertragliche Haftung) arises from a breach of contract. If a party fails to fulfill their contractual obligations, they can be held liable for any resulting damages. Tortious Haftung (deliktische Haftung), on the other hand, arises from wrongful acts committed outside of a contractual relationship, such as negligence or intentional harm. This is typically governed by provisions in the German Civil Code (BGB).

Vicarious liability (Erfüllungsgehilfe Haftung) is another important aspect, where one party can be held responsible for the actions of another person they employ or are otherwise responsible for, provided that person acted within the scope of their duties. This is often seen in employment relationships, where an employer may be liable for the negligent acts of their employees. Strict liability (Gefährdungshaftung) also exists in specific areas, meaning liability can be imposed regardless of fault, such as in cases involving dangerous activities or products. The assessment of Haftung often involves determining fault, causation, and the extent of damages.
