Félagshagirétt

Félagshagirétt is an Icelandic legal term that translates to "association law." It refers to the legal framework governing the establishment, operation, and dissolution of voluntary associations in Iceland. The legal basis for félagshagirétt is primarily found in the Association Act No. 105/2008, which outlines the rights and obligations of associations, their members, and the state.

The Association Act defines an association as a voluntary organization of individuals who have come together for a common purpose. Associations can be formed for various purposes, including cultural, educational, sports, and charitable activities. To establish an association, a minimum of three individuals must sign a founding document, known as a stofnunarskrá, which outlines the association's name, purpose, and initial members.

Associations have the right to own property, enter into contracts, and represent their members in legal matters. However, they are not considered legal persons and must operate through their members or representatives. Associations are required to maintain accurate records of their activities and financial transactions, and they must submit annual reports to the District Court.

The state recognizes the autonomy of associations, but it also imposes certain obligations and responsibilities. Associations must comply with the Association Act and other relevant laws, and they may be subject to inspection by the authorities. The state may also provide financial support to associations that meet certain criteria, such as those engaged in cultural or educational activities.

In recent years, there has been a growing interest in the role of associations in Icelandic society, and the Association Act has been amended to reflect this interest. The most recent amendment, in 2018, introduced new provisions regarding the rights of association members and the transparency of association activities. Despite these developments, the fundamental principles of félagshagirétt remain focused on promoting voluntary association and the common good.
