FCIL, or the Foreign-Competition Incentives Law, is a piece of legislation in the United States that aims to promote competition and innovation in the technology sector. Enacted in 2018, the law provides a framework for companies to challenge the acquisition of U.S. companies by foreign entities, arguing that the acquisition would result in less competition or innovation. The law allows companies to file a petition with the U.S. International Trade Commission (ITC) to challenge an acquisition, which can then be reviewed by the ITC and the Federal Trade Commission (FTC).
