Eesõigust

Eesõigust is an Estonian legal term that translates to "pre-emption right" or "right of first refusal." It is a right granted to a specific person or entity to have the first opportunity to purchase a property or asset before it can be offered to anyone else. This right is typically established by contract, law, or court order.

In essence, if the owner of a property decides to sell it, they are legally obligated to offer it to the holder of the eesõigust first, on the same terms and conditions as they would offer it to a third-party buyer. The holder of the eesõigust then has a specified period to decide whether to exercise their right and purchase the property. If they choose not to exercise the right, the owner is then free to sell the property to another party.

Eesõigust can arise in various situations. For example, it might be granted to a tenant who wishes to purchase the property they are renting, or to a co-owner of a property who wants to buy out another co-owner's share. In some cases, it can also be established by statute, such as in agricultural land transactions to promote consolidation of farms. The specific terms and conditions of an eesõigust are usually detailed in the agreement that creates it, including the duration of the right and the notification procedures.
