The concept also encompasses the broader framework of guardianship and caregiving in social and legal contexts.

In Germany, the guardianship law (Betreuungsrecht), contained in the Bürgerliches Gesetzbuch (BGB), governs how adults who lack capacity can be provided for. A court may appoint a gesetzlicher Betreuer to represent and assist the person in specified areas, which may include financial matters, personal care, housing, and health decisions. The guardian can be a family member, a friend, or a professional service. The appointment aims to balance protection with the respect for the person’s autonomy, require regular reporting to the court, and limit the guardian’s authority to the necessary scope.

The appointment process typically begins with an application to the local district court (Amtsgericht), supported by medical assessments and social information. The court evaluates capacity and, if appropriate, designates a guardian with defined tasks (Aufgabenkreise). The Betreuer must act in the best interests of the Bedürftiger, keep records, and involve the person in decisions to the extent possible.

Alternatives and support mechanisms exist to avoid or minimize formal guardianship, such as Vorsorgevollmacht (advance care or financial power of attorney) or Vorsorge treffen through trusted arrangements. These tools allow individuals to designate confidants to act if incapacity arises.
