tilbyderen

Tilbyderen is a term used in Norwegian and Danish legal and business contexts to describe the person or organization that submits an offer in a negotiation, auction, or procurement process. The tilbyderen provides a proposal containing price, terms, delivery schedules, and other conditions, directed to the recipient—often the buyer, contracting authority, or seller. The offer becomes legally significant when it is received by the other party and, if the terms are definite and the parties intend to be bound, may form the basis of a contract upon acceptance.

In procurement procedures, several tilbydere compete by submitting offers (tilbud). These offers are evaluated according to predefined criteria such as price, quality, lead times, and compliance with requirements. The contract is typically awarded to the offer that best meets these criteria, not necessarily the lowest price.

An offer can usually be revoked by the tilbyderen before acceptance, unless the offer has declared irrevocability or a bid bond establishes a binding period.
