Võlasuhte

Võlasuhe is an Estonian legal term referring to a legal relationship where one party, the creditor (võlausaldaja), has a right to demand performance from another party, the debtor (võlgnik). This performance can be in the form of payment, providing a service, or refraining from an action. The debtor, in turn, has an obligation to fulfill this demand.

The existence of a võlasuhe typically arises from a legal transaction, such as a contract, or from a tort. For instance, a loan agreement creates a võlasuhe where the lender is the creditor and the borrower is the debtor. Similarly, if someone causes damage to another's property, a võlasuhe is established, obligating the perpetrator to compensate the injured party.

The rights and obligations within a võlasuhe are governed by Estonian contract law and other relevant legislation. If the debtor fails to perform their obligation, the creditor generally has legal remedies available, such as demanding fulfillment of the obligation, claiming damages, or terminating the legal relationship. The specific remedies and procedures are detailed in the Estonian Law of Obligations Act. A võlasuhe can be extinguished in various ways, including by performance, agreement between the parties, or by statute of limitations.
