Riittävyspäätöksiin

Riittävyspäätöksiin, often translated as sufficiency decisions, are a concept primarily found in Finnish administrative law, particularly in the context of social welfare and benefits. These decisions concern whether an applicant has provided enough information and documentation for an authority to make a substantive decision on their application. The principle aims to ensure that authorities can process applications efficiently and fairly, while also placing a reasonable burden of proof on the applicant.

When an authority receives an application, such as for unemployment benefits, housing allowance, or other social assistance, they assess the submitted information. If the information is deemed insufficient to determine eligibility or the correct amount of benefit, the authority may issue a riittävyspäätös. This decision typically outlines what specific information or documents are missing and sets a deadline for the applicant to provide them.

The purpose of a riittävyspäätös is not to deny the application outright but to request further clarification. If the applicant fails to provide the requested information within the specified timeframe, the authority may then proceed to make a decision based on the available, albeit incomplete, information. This often results in the application being rejected or a benefit being granted at a lower rate than potentially possible.

The concept emphasizes the shared responsibility between the applicant and the authority.
