Mietübernahme
Mietübernahme, also known as rent takeover, is a legal process in Germany where a landlord can take over the rent payments from a tenant who is unable to pay. This process is governed by the German Civil Code (Bürgerliches Gesetzbuch, BGB) and is intended to protect the landlord's financial interests. The tenant must be in arrears for at least three months and must have been given a written notice to pay the outstanding rent within a specified time frame. If the tenant fails to pay, the landlord can apply to the court for a Mietübernahme order. Once the order is granted, the landlord becomes responsible for the rent payments, and the tenant is relieved of their obligation to pay. The tenant can still appeal the decision within a certain time frame. Mietübernahme is a legal remedy for landlords to recover unpaid rent and should be used as a last resort after all other attempts at communication and negotiation have failed. It is important to note that Mietübernahme does not affect the tenant's right to live in the property, but it does mean that the tenant will no longer be responsible for the rent payments.
