Håndhevingspraksis refers to the set of practices used by public authorities to enforce legal obligations, such as debts, fines, taxes, or court decisions. It includes the steps taken to collect payments by compulsory means, seize assets, and enforce payment through income garnishment or other measures, while aiming to respect the debtor’s essential needs and rights.

Legal basis and actors: In Norway, the main framework is the Tvangsfullbyrdelsesloven (Compulsory Enforcement Act) and associated regulations. The enforcement authority (the namsmyndighet) administers enforcement on behalf of courts and creditor authorities. The process can be initiated by a court decision or a formal enforcement order and is subject to procedural safeguards.

Procedures and instruments: When payment fails, enforcement actions may include attachments of assets (utlegg), wage garnishment (lønnstrekk), bank account levies, or real property levies, possibly followed by public sale. For fines and taxes, the respective public authorities oversee enforcement. Debtors receive notices, may propose repayment plans, and can appeal or challenge actions.

Rights and exemptions: The law provides protections for basic living needs, including essential household effects, necessary clothing, work tools, and a minimum livelihood allowance. Debtors have rights to information, to contest actions, and to request adjustments to repayment schedules.
