Eesõigused

Eesõigused refers to a concept of pre-emption rights or rights of first refusal in Estonian law. It is a legal right that gives a specific party the opportunity to purchase a property or asset before it can be offered to other potential buyers. This right is typically established by law or through a contractual agreement. For example, in the context of real estate, existing co-owners of a property may have an eesõigus to purchase the share of another co-owner if that co-owner decides to sell. This ensures that existing stakeholders have control over who their future co-owners might be.

The purpose of eesõigused is often to maintain existing relationships, protect specific interests, or prevent fragmentation of ownership. When a property owner intends to sell, they are legally obligated to first offer the property to the holder of the eesõigus under the same terms and conditions as they would offer it to a third party. The holder of the right then has a specified period to decide whether to exercise their right. If they do not exercise it within the stipulated timeframe, the owner is then free to sell the property to any other buyer. Eesõigused can be a significant factor in property transactions, requiring careful consideration by all parties involved.
