Upplåtelsen is a term used to describe the act of granting another party a right to use or occupy property or resources for a defined period, without transferring ownership. The grantor retains ownership, while the grantee gains a legally enforceable use right. The arrangement can concern land, buildings, or other facilities and can be formalized through contracts or administrative decisions.

The concept covers several forms of use rights, including hyresavtal (rental contracts), arrende (lease of agricultural land), and tomträtt (land tenure granted by a municipality). Upplåtelse can occur between private parties, or between public authorities and private actors, and the terms typically specify duration, compensation, permitted use, responsibilities for maintenance, and other conditions.

Public sector applications are common, as upplåtelse of land or buildings is a standard tool in urban development, housing supply, and public utilities. Municipalities or state agencies may grant rights to use land to developers, tenants, or associations under defined conditions. This arrangement differs from an outright sale or transfer of ownership (överlåtelse); the rights granted are non-ownership rights and can be temporary or long-term.

Termination and renewal depend on the contract terms or applicable law. Rights may be curtailed or renegotiated if the purpose of the arrangement changes, if terms are breached, or if the grant period ends.
