ulosottopyynnön

Ulosottopyyntö, which translates to "writ of execution" or "enforcement application" in English, is a legal document filed in Finland to initiate enforcement proceedings. It is submitted by a creditor to the Enforcement Authority (ulosottolaitos) when a debtor has failed to voluntarily fulfill a financial obligation. This obligation is typically based on a legally enforceable judgment, such as a court ruling, a payment order, or a settlement agreement. The ulosottopyyntö formally requests the Enforcement Authority to take action to collect the outstanding debt.

The ulosottopyyntö must contain specific information to be processed. This includes details about the creditor and the debtor, the amount of the debt, the basis for the debt (e.g., the judgment document), and the creditor's desired enforcement measures. Common enforcement measures include wage garnishment, seizure of bank accounts, or the sale of movable or immovable property. The Enforcement Authority then reviews the application to ensure it meets the legal requirements. If approved, they will begin the enforcement process, which aims to recover the debt from the debtor's assets. The debtor is notified of the application and the commencement of enforcement proceedings.
