Contestazione is an Italian noun that broadly denotes the act of disputing, opposing, or challenging something. In legal contexts, contestazione often refers to the formal accusation or charge issued against a person. In criminal procedure, the atto di contestazione (the notice of charges) is the document by which the public prosecutor informs the accused of the alleged facts and the legal grounds, marking the start of the formal prosecution stage. It defines the scope of the defense, which the accused may present through defenses, witnesses, or legal submissions. The concept is tied to the right to a fair defense and to due process.
