Pledgees

A pledgee is a party to whom a pledge is made. In a pledge, one party, the pledgor, transfers possession of personal property to another party, the pledgee, as security for the performance of an obligation, usually a debt. The pledgee holds the property until the obligation is fulfilled or the pledgor defaults.

The pledgee has certain rights and responsibilities concerning the pledged property. Their primary right is to retain possession of the property until the debt is repaid. If the pledgor fails to meet their obligation, the pledgee typically has the right to sell the pledged property to recover the amount owed. However, this right is usually subject to legal procedures and notification requirements.

The pledgee also has a duty of care towards the pledged property. They must take reasonable steps to protect the property from damage or loss. The extent of this duty can vary depending on the jurisdiction and the nature of the collateral. If the pledgee fails to exercise due care and the property is damaged or lost due to their negligence, they may be held liable for the loss.

Upon the satisfactory fulfillment of the obligation by the pledgor, the pledgee is obligated to return the pledged property to the pledgor in the same condition as it was received, allowing for normal wear and tear. This return of the property signifies the completion of the pledge agreement. Pledge agreements are common in various financial transactions, including pawn shop loans and certain types of secured lending.
